A booking deposit equal to 20% of the total quoted amount is required to secure your event date.

Your event date will be held for 14 calendar days from the date your booking invoice is issued. Your booking is confirmed once both your signed Booking Agreement and booking deposit have been received.

If these are not received within the 14-day period, the date may be released to other clients. If you decide to proceed after this time, availability and pricing will need to be reconfirmed.

Your proposal does not secure or reserve your event date unless otherwise agreed in writing.

The remaining balance is due four weeks before your event date, unless another payment arrangement has been agreed in writing.

Payment may be made using the payment methods provided on your invoice.

If a payment becomes overdue, we will first send a payment reminder. If payment remains outstanding, a formal overdue notice may be issued.

If an outstanding balance remains unpaid, we will contact you regarding the status of your booking and any next steps before taking further action.

Your floral proposal is created using the information, inspiration images, colour preferences and overall style you have shared with us.

Flowers and foliage are natural products, so variations in colour, shape, size and appearance are to be expected. The finished designs will therefore not be identical to inspiration images or previous Eliau Floral Design work.

Inspiration images are used to understand the overall style, colour palette, shape and feeling you are drawn to rather than as designs to be exactly replicated.

Within the agreed design direction, you give Eliau Floral Design reasonable creative discretion to select flowers, foliage and other floral materials that best suit your arrangements and overall event design.

Flowers are seasonal natural products and availability can be affected by weather, growing conditions, quality and circumstances within the flower supply chain.

Where a particular flower variety has been specifically agreed upon, we will not intentionally substitute that variety without discussing the available alternatives with you and seeking your approval wherever reasonably possible.

However, we cannot guarantee the availability of any particular flower variety, even where it has previously been confirmed or expected to be available.

If an agreed variety becomes unavailable or is not of a suitable quality, we will let you know and discuss suitable alternatives with you wherever reasonably possible. Any proposed substitution will take into consideration the agreed style, colour palette, overall design and value of your arrangements.

If circumstances do not reasonably allow time for approval before the flowers must be purchased or prepared, Eliau Floral Design may use professional judgement to select the most appropriate available alternative while remaining as close as reasonably possible to the agreed design.

Your floral designs, quantities and other booking details must be finalised six weeks before your event date.

Requests for changes should be made in writing.

Changes requested before the six-week deadline will generally be accommodated where reasonably possible. Any change may result in a revised price where it changes the flowers, materials, quantities, labour, logistics or other requirements of your booking.

Where a requested reduction affects work already completed, materials already purchased, supplier commitments already made or other costs that cannot reasonably be recovered, those costs may still be payable. We will explain any applicable costs when considering the requested change.

After the six-week deadline, reductions or significant design changes may not be possible. Requests for additional flowers or services may still be considered, subject to our availability, flower and material availability and any additional costs.

Any agreed changes will be confirmed in writing.

If you need to cancel your booking, please notify Eliau Floral Design in writing as soon as possible.

Cancellation charges will be considered individually rather than applying a single fixed cancellation percentage.

In determining any amount that may be retained or payable following cancellation, we may take into account reasonable costs associated with your booking, including:

• design and administrative work already completed;

• flowers, plants, materials or other items purchased specifically for your event;

• supplier orders or commitments that cannot reasonably be cancelled or recovered;

• work already undertaken in preparation for your event; and

• other reasonable and directly related costs or losses arising from the cancellation, taking into account costs that have been avoided or reasonably recovered.

We will provide an explanation of any cancellation charges and any amount to be refunded or remaining payable.

Nothing in these Terms & Conditions is intended to exclude or limit any rights you may have under the Australian Consumer Law.

If you need to postpone your event, please notify us in writing as soon as possible.

Where Eliau Floral Design is available on your new date, your booking may be transferred to a new event date occurring within 12 months of the original event date.

A transferred booking may be subject to additional costs where circumstances have changed. This may include increases in flower or material costs, additional supplier charges, changes to venue or logistical requirements, or changes to the scope of your event.

Any additional costs will be discussed with you and confirmed in writing.

If Eliau Floral Design is unavailable on your proposed new date, we will discuss the available options with you. Where the booking cannot reasonably be transferred, the cancellation provisions in these Terms & Conditions will apply, subject to your rights under applicable law.

Where delivery is included in your booking, the delivery location, approximate timing and relevant access information will be confirmed before your event.

You are responsible for providing accurate addresses, contact details and relevant delivery information.

Where flowers are being delivered to a venue, accommodation property or another third party, you are responsible for ensuring that we are permitted to access the location at the agreed time.

We will take reasonable care to deliver your flowers at an appropriate time and in suitable condition.

Where client collection has been agreed, a collection time must be scheduled with Eliau Floral Design in advance.

Please arrive at the agreed time or contact us if your collection arrangements change.

We will prepare and package your flowers appropriately for collection and provide relevant care or transport instructions where required.

Once collected, you are responsible for transporting, storing and caring for the flowers appropriately. This includes protecting them from excessive heat, direct sunlight, wind and other conditions that may affect fresh flowers.

Your proposal will specify which delivery, setup, relocation and pack-down services are included in your booking.

Relocation of ceremony flowers to another area is only included where it has been specifically agreed and included in your proposal.

Pack-down and hire-item collection arrangements will vary depending on your venue and the services you have booked. These arrangements will be confirmed before your event.

Eliau Floral Design may make reasonable adjustments to setup timing or the way the agreed services are carried out where necessary to respond to weather, venue conditions or other circumstances on the day.

Where these adjustments are reasonably required to provide the services already included in your booking, you will not be charged additional labour simply because the agreed services take longer than originally anticipated.

Where Eliau Floral Design has been engaged to relocate, move or pack down floral arrangements, please ensure those arrangements are not moved, dismantled or altered by another person before the agreed service takes place.

Eliau Floral Design is not responsible for damage caused by arrangements being moved, handled, dismantled or altered by another person.

Occasionally, a venue, client or another supplier may request or require a new service on the event day that falls outside the scope of your agreed booking.

This might include an unplanned return to the venue, additional relocation of floral arrangements, or pack-down or collection services that were not previously included.

Where reasonably possible, we will explain the additional requirement and obtain approval from you or your nominated representative, such as your wedding planner or coordinator, before undertaking chargeable additional work.

You are responsible for ensuring that a nominated representative has authority to approve additional services and associated charges on your behalf.

Where additional services are approved, labour will be charged at:

Before 6:00 pm — $55 per hour
From 6:00 pm onwards — $70 per hour

Any other costs associated with the additional service, such as travel, parking or additional materials, will be discussed where applicable.

Additional charges will be itemised and invoiced following the event or as otherwise agreed.

You are responsible for providing us with any known venue requirements that may affect the delivery, installation, relocation, pack-down or collection of your flowers.

This includes relevant access times, loading requirements, installation restrictions, required pack-down times and venue rules relating to floral installations.

Where appropriate, Eliau Floral Design will liaise directly with your venue, wedding planner or coordinator regarding event-day logistics.

If we are informed of an additional venue requirement that was not previously disclosed and requires services outside those included in your booking, we will discuss the available options with you or your nominated representative. Additional services may be charged in accordance with Section 11.

Where venue restrictions or conditions mean that an agreed installation cannot be completed exactly as planned, we will use reasonable professional judgement and, where practical, discuss suitable alternatives with you or your nominated representative.

Outdoor floral installations are subject to weather and environmental conditions.

Where conditions such as excessive heat, strong winds, rain or storms may affect the quality, safety or longevity of the flowers or installation, Eliau Floral Design may make reasonable adjustments to the setup timing, placement, mechanics or installation method.

Where possible, significant changes will be discussed with you, your nominated representative or your venue before proceeding.

Our priority will be to preserve the agreed overall design as closely as reasonably possible while protecting the flowers, guests, venue and suppliers.

All vases, plinths, stands, vessels, structures and other items identified as hire items remain the property of Eliau Floral Design.

Hire items will be collected by Eliau Floral Design either at the conclusion of the event or at an agreed later time, depending on venue requirements and the collection or pack-down services included in your booking.

Collection arrangements will be confirmed before your event.

You are responsible for taking reasonable care of hire items from the time they are delivered or collected until they are returned to or collected by Eliau Floral Design.

Hire items must remain at the agreed location and be reasonably accessible at the scheduled collection time.

If an item cannot be located or accessed at the agreed collection time, reasonable additional costs associated with returning to the venue or recovering the item may be charged.

Where a hire item is lost, stolen or damaged beyond reasonable wear and tear while under your responsibility, you may be charged the reasonable cost of repair or replacement.

Where appropriate, you may nominate another person, such as your wedding planner, coordinator or trusted family member, as your event-day contact.

This person may communicate with Eliau Floral Design about event-day logistics and may approve reasonable changes or additional services on your behalf where you have authorised them to do so.

This helps us manage any unexpected logistical matters without unnecessarily interrupting you on your wedding or event day.

Occasionally, circumstances outside either party's reasonable control may affect the event or our ability to provide the agreed services. These circumstances may include severe weather, natural disasters, significant transport disruption, venue closure, government restrictions, widespread supply disruption or other comparable events that could not reasonably have been prevented.

If this occurs, we will contact you as soon as reasonably possible and work with you to consider practical alternatives.

Depending on the circumstances, this may include adjusting the design, timing, delivery, installation or other aspects of the services.

Any changes to costs, refunds or other arrangements will be considered having regard to the circumstances, work already completed, costs incurred or recoverable and the parties' rights and obligations under applicable law.

If circumstances arise that mean Eliau Floral Design cannot provide some or all of the agreed services, we will notify you as soon as reasonably possible.

Where appropriate, we may discuss reasonable alternatives with you, which could include arranging suitable assistance or an alternative floral professional with your agreement.

If the agreed services cannot be provided and a suitable alternative cannot be arranged, any refund or other remedy will be determined in accordance with applicable law, including the Australian Consumer Law.

Fresh flowers are delicate, perishable natural products. Their condition and longevity can be affected by heat, direct sunlight, wind, lack of water, handling, movement and other environmental conditions.

Eliau Floral Design will take reasonable care to ensure your flowers are appropriately prepared, conditioned and presented when they are delivered, installed or made available for collection.

Once flowers have been delivered, installed or collected, you are responsible for following any care or handling instructions provided and, where the flowers remain under your or the venue's control, taking reasonable steps to protect them from conditions or handling that may cause damage or deterioration.

Eliau Floral Design is not responsible for deterioration or damage occurring after delivery, installation or collection where it is caused by:

• care or handling instructions not being followed;

• flowers being moved, altered or handled by the client, guests, venue staff or other suppliers;

• accidental damage caused by another person, including arrangements being knocked over, disturbed or otherwise damaged;

• flowers being exposed to unsuitable conditions such as excessive heat, direct sunlight, wind or insufficient water after responsibility for their care has passed to the client or venue; or

• another act or circumstance outside Eliau Floral Design's reasonable control after the flowers have been supplied.

Where Eliau Floral Design remains responsible for the flowers as part of an agreed service, such as relocation of arrangements, we will continue to take reasonable care of them while carrying out that service.

Nothing in this section excludes or limits Eliau Floral Design's responsibility where damage or deterioration results from a failure to provide the flowers or services with the standard required by applicable law, including the Australian Consumer Law.

Eliau Floral Design may photograph completed floral arrangements for portfolio and record-keeping purposes, provided doing so does not unreasonably interfere with your event and is permitted by the venue.

Permission to publish or use photographs featuring you or other identifiable people for Eliau Floral Design's website, social media or other marketing will be requested separately.

Where you provide professional photographs to Eliau Floral Design for marketing purposes, you are responsible for letting us know of any photographer credit or usage requirements that have been communicated to you.

We will respect any photography or privacy restrictions agreed with you.

If you have a concern about your flowers or the services provided, please contact Eliau Floral Design as soon as reasonably possible so that we have an opportunity to understand the issue and, where possible, work with you towards an appropriate resolution.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Any agreed changes to your booking, proposal or these Terms & Conditions should be confirmed in writing.

The version of these Terms & Conditions accepted when you book will continue to apply to your booking unless you and Eliau Floral Design subsequently agree to a change in writing.

These Terms & Conditions form part of your Wedding & Event Booking Agreement.

By signing your Booking Agreement, you acknowledge that you have been provided with these Terms & Conditions and agree that they form part of your booking.

Your Booking Agreement, accepted proposal, these Terms & Conditions and any subsequent written variations together form the agreement between you and Eliau Floral Design.
